Family Mediation
The process of mediation exists where you and the party with whom you have a dispute agree to appoint a third party 'mediator' to agree an outcome or solution to the problem.
It is commonly used in family situations, such as divorces, because parties find that it may generally be better to keep the legal dispute out of court. This is often less stressful and less costly for those involved. Mediation generally provides parties with a greater deal of scope for compromise, rather than the more complicated nature of court.

Keeping the dispute out of court, in what can be otherwise termed 'extrajudicial proceedings', can also reduce costs significantly. In addition, from 6th April 2011, a Mediation Assessment, which should be obtained outside of the courts, will be required for divorcing couples before going to court to debate finances on divorce.
Although mediation is informal, you should not go into mediation without first consulting a solicitor specialised in the area of the dispute. They will provide advice about the mediation process, whether or not it is suitable for your dispute and can refer you to a suitable mediator. They will also be there to advise you throughout the process and can utilise years of experience to make sure you get the best possible result.
